It is estimated that more than 40% of all ADA Lawsuits in the United States are filed in the state of California. As a result, new legislation is being introduced to help small businesses who have been hit particularly hard by ADA lawsuit filing, especially in cases that seem to be maliciously filed. If a property owner makes a good faith effort to comply with ADA requirements, a reduced penalty can be imposed lowering statutory damages from $4000 per violation to $1000 per violation. Stacking multiple claims will also be restricted, with plaintiffs being required to explain the need for repeated visits to the same business with a known access barrier.
